1. Introduction and Acceptance
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and NICKD ("we," "us," or "our") governing your access to and use of the NICKD mobile application (the "App").
By downloading, accessing, or using the App, you expressly agree to be bound by these Terms. If you do not agree to these Terms, you must immediately stop using the App and delete it from your device.
We operate primarily in Victoria, Australia. These Terms are drafted considering Victorian laws, including the Road Safety Road Rules 2017 and the Surveillance Devices Act 1999 (Vic).
2. Critical Safety and Legal Warnings
⚠️ SAFETY FIRST:
Failure to follow these rules may result in immediate termination of your account and potential legal liability.
A. Public Roads ONLY Rule
The App uses camera technology to scan surroundings. In Victoria, strict laws govern optical surveillance.
- You agree that you will only use the App's automatic scanning feature while on public roads and highways.
- You must not use the App to scan into private property, driveways, garages, or any area where individuals have a reasonable expectation of privacy.
- Using this App to intentionally scan private property may violate the Victorian Surveillance Devices Act 1999 and expose you to severe criminal penalties. NICKD takes no responsibility for your illegal use of the technology.
B. Driver Distraction and Road Safety
- It is illegal in Victoria to touch an unmounted mobile phone while driving.
- The App is designed to run passively. You must have your phone secured in a commercially approved mount while the vehicle is moving if the App is running.
- Your primary duty is to drive safely. NICKD is not liable for any accidents, fines, or traffic violations incurred while using the App.
3. The Stolen Vehicle Alert System
The App uses artificial intelligence to scan license plates automatically and compare them against a database of reported stolen vehicles to provide alerts ("Hits"). You acknowledge and agree to the following:
A. Database Accuracy Disclaimer
- The database used by NICKD is built from crowdsourced public information and user reports. It is not a live police database.
- We do not guarantee that the information is accurate, complete, current, or reliable. A vehicle may be recovered by its owner but still appear as "stolen" in our data.
B. Protocol for a "Hit" (The "Call 000" Rule)
If the App detects a potential stolen vehicle, you agree to strictly follow this protocol:
- DO NOT INTERVENE: You must not approach the vehicle, follow it, or confront the driver. The occupants may be dangerous.
- Prioritise Road Safety: Do not react to an alert in a way that compromises safe driving (e.g., sudden braking).
- Use the "Call 000" Button: If it is safe to do so, use the in-app button to connect with emergency services.
- Inform Police: State clearly that your location information comes from a crowdsourced mobile application.
4. User Accounts and Data Accuracy
- Registration: You must provide accurate information when creating an account.
- Reporting: If you report a vehicle as stolen, you warrant that the information is truthful. Knowingly submitting false reports is a breach of these Terms.
- Verification: To access detection data about your own vehicle, you must submit proof of ownership satisfactory to us.
5. Intellectual Property & Commercial Data Rights
💼 DATA LICENSING & COMMERCIAL USE:
To keep the NICKD platform free for the community, we may commercialize aggregated Vehicle Intelligence Data.
A. Your License to Us: By submitting data (such as stolen vehicle reports, sightings, photos, or GPS locations) to the App, you grant NICKD a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, distribute, and display that data for any purpose, including:
- Operating and improving the Service.
- Sharing Vehicle Intelligence Data (Asset location and condition) with verified Commercial Partners (e.g., Insurance Companies).
Note: We never sell your Personal Identity (Name/Email). See Privacy Policy.
B. App Ownership: All rights, title, and interest in the App, including the AI recognition software, database structure, logos, and code, remain the exclusive property of NICKD.
6. Limitation of Liability
To the maximum extent permitted by Australian law:
- The App is provided "as is." We do not warrant that the App will be error-free or accurate.
- Exclusion of Damages: NICKD, its directors, and partners shall not be liable for any damages, personal injury, or property damage resulting from your use of the App or reliance on any alert.
7. Governing Law
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.
8. Changes to Terms
We may revise these Terms at any time. By continuing to use the App after changes become effective, you agree to be bound by the revised Terms.
